Terms of Service
1. Agreement to these Terms
These Terms of Service (“Terms”) form a binding agreement between you (“you,” “your,” or “User”) and Roomshoot, LLC, a Delaware limited liability company (“RoomShoot,” “we,” “us,” or “our”), governing your access to and use of the RoomShoot website at roomshoot.com and all related services (collectively, the “Service”).
By creating an account, purchasing credits, uploading a photo, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, you may not use the Service.
If you are using the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to that organization.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Service. The Service is not directed to, and may not be used by, anyone under 18. By using the Service you represent that you meet these requirements.
3. The Service
RoomShoot is an AI-assisted visualization tool. You upload a photograph of an interior or architectural space, and the Service uses third-party generative AI models to produce AI-generated visual renderings interpreting that space.
You understand and agree that:
- Outputs are AI-generated. The frames you receive are synthetic images created by an AI model interpreting your input photo. They are not literal photographs of your space and may add, remove, alter, or stylize features, lighting, furnishings, finishes, or proportions.
- Results vary. Output quality and accuracy depend on your input photo and on factors outside our control. We do not guarantee any particular result, resemblance, resolution, or fitness for a particular purpose.
- The Service is not professional photography or a professional service and does not replace a licensed photographer, appraiser, inspector, or other professional where one is required.
- We may modify, suspend, or discontinue any part of the Service at any time. We will use reasonable efforts to notify you of material changes that affect purchased credits.
4. Accounts
To use most features you must create an account using an email address or a supported third-party sign-in (such as Google). You agree to provide accurate information and to keep it current. You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials. Notify us promptly at support@roomshoot.com if you suspect unauthorized use.
5. Credits, Packs, and Pricing
5.1 How credits work
The Service operates on a prepaid credit system. You purchase credits in one-time packs and spend them to generate shoots. As of the effective date, the available packs are:
- Starter — $4.99 one-time · 100 credits · approx. 1 room
- Standard — $24 one-time · 600 credits · approx. 6 rooms
- Pro — $69 one-time · 3,000 credits · approx. 30 rooms
A “room” is a single shoot that generates one set of frames from one uploaded photo. Credit costs per shoot and pack contents are displayed in the app and may change for future purchases; changes do not affect credits you have already bought.
5.2 Nature of credits
Credits are a limited, prepaid license to use the Service. They:
- are one-time purchases (RoomShoot does not currently offer subscriptions);
- do not expire under our current policy (we may introduce expiration for credits purchased in the future, with notice);
- have no cash value, are not transferable between accounts, and may not be sold, exchanged, or assigned; and
- are not bank deposits, gift cards, or stored-value instruments.
5.3 Re-shoots
Each room includes up to two (2) free re-shoots within 24 hours of the original shoot. Re-shoots do not consume credits. A re-shoot generates a new room and does not delete or replace the original. The 24-hour window exists because a re-shoot regenerates from your original uploaded photo, which is automatically deleted approximately 24 hours after upload (see the Privacy Policy).
6. Payments
Payments are processed by our third-party payment processor, Stripe. By purchasing, you authorize us and Stripe to charge your selected payment method for the total amount shown, including any applicable taxes. You represent that you are authorized to use the payment method you provide. All prices are in U.S. dollars unless stated otherwise. You are responsible for any taxes not collected by us.
7. Refunds
Please read this section carefully. It is a material part of these Terms.
7.1 General Policy — Credits Are a Consumed Digital Good
Credits and generated outputs are digital goods that are consumed when used. Except as expressly stated in this Section 7, all purchases are final and non-refundable, and credits already spent on a successfully delivered shoot are not refundable because the Service was provided.
7.2 Failed Generations Are Automatically Credited Back
If a shoot fails for technical reasons on our side (for example, the AI model errors out or the generation cannot be completed), the credits for that shoot are automatically returned to your balance. You are not charged credits for a failed shoot. This automatic credit-back is your primary and ordinary remedy for a generation that does not complete.
7.3 Monetary Refunds Are Discretionary, Full-Only, and Human-Authorized
Beyond the automatic credit-back in Section 7.2, monetary refunds of a purchase are issued solely at RoomShoot’s discretion and are reviewed and authorized by a person. We do not offer partial refunds. A monetary refund, if granted, refunds the full amount of the original purchase.
7.4 Refund Effect on Credits
If RoomShoot issues a monetary refund for a purchase, RoomShoot may remove from your account any unused credits associated with that purchase.
Credits that have already been consumed to generate successfully delivered outputs are generally not refundable and may not be restored following a refund.
RoomShoot reserves the right to suspend or limit account access in cases of fraud, abuse, excessive chargebacks, misuse of the refund process, or other conduct that threatens the integrity of the Service.
7.5 Chargebacks
If you believe a charge is in error, contact us first at support@roomshoot.com so we can help. Initiating a chargeback or payment dispute without first contacting us may result in immediate suspension or closure of your account and forfeiture of remaining credits.
7.6 Statutory Rights
Nothing in this Section limits any non-waivable refund or consumer rights you may have under the laws of your jurisdiction.
8. Your Content and the License You Grant Us
8.1 Your Uploads
“User Content” means the photos and any other materials you upload to the Service. You retain ownership of your User Content.
8.2 License to Operate the Service
You grant RoomShoot a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, and create derivative works from your User Content solely to operate and provide the Service to you, including transmitting your uploaded photo to our third-party AI provider to generate your outputs and storing your generated rooms in your account.
This license ends when the relevant content is deleted, except for residual copies in routine backups and except as needed to comply with law.
We do not use your User Content to train our own or third parties’ AI models, and we do not sell your User Content.
8.3 Your Representations About Uploads
You represent and warrant that, for every photo you upload, you have all rights necessary to do so and to authorize the processing described above, and that your upload and use of the resulting outputs:
- do not infringe any third party’s intellectual property, privacy, or publicity rights;
- do not contain images of identifiable people uploaded without their consent;
- do not depict a property or space you lack permission to photograph and have processed; and
- do not violate any law or these Terms.
8.4 Prohibited Content
You may not upload or generate content that is unlawful, infringing, defamatory, sexually explicit, depicts minors, promotes violence or hate, or that is intended to deceive or defraud. We may remove content and suspend accounts for violations.
9. Output Ownership and Responsible Use
9.1 Ownership of Outputs
Subject to your compliance with these Terms and payment of all applicable fees, RoomShoot assigns to you any rights, if any, that RoomShoot may have in the AI-generated outputs created from your User Content. As between you and RoomShoot, you may use such outputs for personal or commercial purposes.
You acknowledge that the legal status, ownership, and copyrightability of AI-generated content is evolving and may vary by jurisdiction. RoomShoot makes no representation that any output is eligible for copyright protection or that your use of any output will not implicate third-party rights.
9.1A Similarity of Outputs
You acknowledge that AI-generated outputs are produced through automated processes and may not be unique. Outputs generated for you may be similar or identical to outputs generated for other users and may resemble content created independently by third parties. RoomShoot does not guarantee the uniqueness or exclusivity of any output.
9.2 Responsible Use
Because outputs are AI-generated interpretations and not literal photographs, you are solely responsible for ensuring your use of them is truthful and lawful.
This is especially important if you use outputs to market a property, listing, rental, restaurant, hotel, or other space. You are responsible for complying with all applicable laws, regulations, platform rules, and professional or ethical standards, including real estate advertising rules, MLS rules, short-term-rental platform policies, and consumer-protection and truth-in-advertising laws, and for not misrepresenting a space to consumers.
RoomShoot is a creative tool and does not review or approve how you use your outputs.
10. Acceptable Use
You agree not to:
- reverse engineer, scrape, or attempt to extract the underlying models or source;
- circumvent rate limits, credit accounting, or security;
- resell or provide the Service to third parties except for your own client work;
- use the Service to build a competing product;
- interfere with the Service’s operation; or
- use the Service to violate any applicable law, regulation, court order, professional rule, platform policy, or third-party right.
We may enforce technical limits to protect the Service.
10.1 Copyright Complaints
RoomShoot respects intellectual property rights. If you believe that content made available through the Service infringes your copyright or other intellectual property rights, please contact support@roomshoot.com with sufficient information to identify the allegedly infringed work and the material at issue.
We reserve the right to investigate claims, remove content, disable access to content, and suspend or terminate accounts of repeat infringers where appropriate.
11. Intellectual Property
The Service, including its software, design, branding, “RoomShoot” name and logo, and all related content (excluding your User Content and your outputs), is owned by Roomshoot, LLC or its licensors and is protected by intellectual property laws.
We grant you a limited, revocable, non-transferable license to use the Service as permitted by these Terms. No other rights are granted.
12. Third-Party Services
The Service relies on third-party providers for payment processing, AI image generation, cloud hosting and database, authentication and storage, and transactional email.
Your use may be subject to those providers’ terms, and we are not responsible for their acts or omissions.

13. Disclaimers
THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT OUTPUTS WILL MEET YOUR EXPECTATIONS, BE ACCURATE, OR BE FIT FOR ANY PARTICULAR USE.
YOU USE OUTPUTS AT YOUR OWN RISK.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOMSHOOT AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Roomshoot, LLC and its owners, members, officers, employees, contractors, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from:
- your User Content;
- your outputs and how you use them;
- your violation of these Terms; or
- your violation of any law or third-party right.
16. Termination
You may stop using the Service and delete your account at any time.
We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users.
On termination, your right to use the Service ends.
Sections that by their nature should survive termination, including Sections 7, 8.3, 9, 11, 13, 14, 15, and 17, will survive.
Except where a refund is granted under Section 7, terminating your account does not entitle you to a refund of unused credits.
16.1 Force Majeure
RoomShoot will not be liable for any delay, interruption, or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, internet or telecommunications failures, power outages, labor disputes, governmental actions, cyberattacks, failures of third-party service providers, or other events beyond our reasonable control.
17. Dispute Resolution; Governing Law
17.1 Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.
17.2 Arbitration and Class-Action Waiver
Except for claims that may be brought in small-claims court, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, seated in Miami-Dade County, Florida.
You and RoomShoot waive the right to a jury trial and to participate in a class action.
Notwithstanding the foregoing, either party may seek temporary, preliminary, or permanent injunctive relief, or pursue claims relating to intellectual property rights, misuse of confidential information, unauthorized access to the Service, or other claims for which equitable relief is appropriate, in a court of competent jurisdiction.
You may opt out of this arbitration agreement by emailing support@roomshoot.com within thirty (30) days of first accepting these Terms.
Class-Action Waiver Severability
If the class-action waiver contained in this Section is found to be unenforceable, invalid, or unlawful for any reason, then the arbitration agreement shall be null and void, and the dispute shall proceed in a court of competent jurisdiction rather than in arbitration.
17.3 Venue (If Arbitration Does Not Apply)
If Section 17.2 is found unenforceable or does not apply, the state and federal courts located in Miami-Dade County, Florida will have exclusive jurisdiction, and you consent to venue there.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by email or in-app) before they take effect.
Your continued use of the Service after the effective date of updated Terms constitutes acceptance.
19. General
These Terms, together with the Privacy Policy, are the entire agreement between you and RoomShoot regarding the Service.
If any provision is held unenforceable, the rest remains in effect.
Our failure to enforce a provision is not a waiver.
You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets.
Nothing in these Terms creates a partnership, agency, joint venture, or employment relationship between you and RoomShoot.
